A slot machine operator was forced to reimburse a gambling addict in the amount of 2.5 million euros. The plaintiff, a Viennese player, was right in the Austrian court after an argument indicating that he was in a state of gambling addiction.

Limitation of slot machines for the fight against addiction

According to a judgment made public Monday, the court has therefore ruled in favor of the player forcing the gaming operator to reimburse his bets for a certain period. Indeed, the complainant had lost all his fortune between 2002 and 2012 in these machines. These facilities were easily accessible to the majority of the clientele in many bars in the Austrian capital. According to an expert report carried out during the trial, the player’s discernment was clearly impaired by his addiction, which pushed him to bet even more money. The court in Wiener Neustadt therefore delivered its verdict in favor of the plaintiff, stipulating that the latter would never have continued if there had been the intervention of the operator in question. Its payments are therefore null and void. As for the operator concerned, it is Novomatic, one of the leaders in slot machines. It sits on the outskirts of Vienna and has offered a plethora of entertainment options since its inception. After the announcement of the sentence, the company appealed.

Gambling addiction is gaining more and more ground, attracting a large number of players. Faced with this increase, the city of Vienna has taken things in hand by prohibiting slot machines operating outside casinos at 1 st January 2015. It must be said that the city had at least 2,600 slot machines.

This is not the first time that a player has been on trial for this kind of case. In France, for example, a gambling addict had filed a complaint against the state. He had asked to include his name in the list of excluded gamblers presenting a form of compulsive gambling. But, following an administrative error, his name did not appear leading him to lose 10,000 euros on online poker sites. His initiative was unsuccessful since the court of Châlons-en-Champagne ruled that the player’s behavior was unorthodox given his career throughout these years. Namely that an operator is required to control the members registered on their platform and on the other side, users have the responsibility to manage their stake.
